Public Hearing Format and Rules of Conduct:

  1. Please turn off pagers and cell phones during the meeting.
  2. Applicant/Representative will be asked to come forth, state their name and address and be sworn in by the Secretary.
  3. Applicants/Representatives will be allowed five (5) minutes to address the Board and present their case. An extension of time may be granted at the discretion of the Chairperson.
  4. Anyone in the audience who wishes to address the Board regarding the current case will be asked by the Chairperson to raise their hands to be recognized.
  5. Once recognized, audience members addressing the Board will be sworn in and given three (3) minutes to speak as an individual or ten (10) minutes to speak if representing a group.
  6. Members of the audience will be allowed to address the Board once unless directly questioned by a Board member or the Chairperson.
  7. The Secretary will read the number of public hearing notices mailed pertaining to the current case. Objection and approval responses will be entered into the record at this time.
  8. The Chairperson will ask for input from the Community Development Department Liaison, the Ordinance Enforcement Officer, the Planning Department and the City Attorney.
  9. The Chairperson will turn the case over to the Board for discussion, clarification and entertain a motion when appropriate.
  10. Impromptu statements from the audience during discussion by the Board will be considered out-of-order.
  11. A roll call vote will be taken to approve or deny the motion on the table and the next case will be called.

Public Remarks

1. Case No. 07-048 filed by Mark Guidobono of Novi Investment Company LLC for Tuscany Reserve located north of Eight Mile Road and west of Beck Road

Applicant is requesting one sign variance for a 45-inch x 60-inch real estate sign erected without a permit and located on the north side of Eight Mile Road east of Barola Drive for the Tuscany Reserve Development. Applicant is also requesting two more sign variances for the placement of the same real estate sign to be located on the north side of Eight Mile Road west of Barola Drive as well as placement farther west on the north side of Eight Mile Road east of Garfield Road. The property is zoned R-A and located north of Eight Mile Road and west of Beck Road.

CITY OF NOVI CODE OF ORDINANCES Section 28-10 (a) Prohibited Signs states: "A sign not expressly permitted is prohibited."

Applicant is requesting three additional real estate sign for Tuscany Reserve.

IN CASE NO. 07-048 MOVE TO APPROVE THE TWO SIGNS: ONE EASTBOUND, ONE WESTBOUND WHERE INDICATED ON THE PROPOSED MAP THAT WAS PROVIDED, 50% OF THE INDICATED SIZE OF THE SIGNS WITH THE REMOVAL OF THE WORDS NEW HOMES AND A LIMITATION OF THEM BEING MAINTAINED AND INSTALLED UP TO 75% CAPACITY SELLING OF THE LOTS, NOT BUILDING OF THE HOMES, BUT SELLING OF THE LOTS FOR HOMES TO BE BUILT OR A MAXIMUM OF TWO YEARS AT WHICH TIME YOU CAN COME BACK AND SEE THE BOARD IF YOU ARE NOT AT THAT CAPACITY DUE TO THE PRACTICAL DIFFICULTIES AS MENTIONED BY THE APPLICANT AND THE FACTS THAT WE DO HAVE REGULATED WOODLANDS ALONG THE ENTIRE FRONTAGE OF THE PROPERTY.

2. Case No. 07-050 filed by Patty Loose of Sign Fabricators for Andiamo Second City located at 42705 West Grand River Avenue

Patty Loose of Sign Fabricators is requesting one 21.2 square foot sign variance and one 2-foot height sign variance for the placement of an 8-foot x 6-foot 4-inch ground sign for Andiamo Second City to be located at 42705 Grand River Avenue. The requested sign will replace a previously approved ground sign in ZBA97-111. Property is zoned TC-1 and located east of Novi Road and south of Grand River Avenue.

CITY OF NOVI, CODE OF ORDINANCES, Section 28-5(2) a. 1. Area height and placement regulations states: Ground Sign: "…ground signs shall not exceed a maximum thirty (30) square feet…"

Applicant is requesting a 51.2 square foot ground sign.

IN CASE NO 07-050 TO DENY THE REQUEST AS STATED DUE TO A DEMONSTRATED LACK OF PRACTICAL DIFFICULTY WHERE THE BOARD FOUND NO SPECIAL CIRCUMSTANCES WITH THIS PROPERTY WHICH REQUIRES THE SIZE OF THIS SIGN AND THE PETITIONER DID NOT MEET THAT BURDEN NOR DID THEY MEET THE BURDEN THAT NOT ALLOWING A SIGN OF THIS SIZE WOULD RESULT IN SUBSTANTIAL JUSTICE TO THE PETITIONER AS WELL AS TO SURROUNDING AREAS.

CITY OF NOVI, CODE OF ORDINANCES, Section 28-5(2) a. 2. ii Area height and placement regulations states: "All other ground signs shall not exceed a height of six (6) feet."

 

3. Case No. 07-057 filed by John D. Douglas of 23820 Lynwood in Echo Valley Subdivision

Applicant is requesting a variance to allow the continued location of an established residential hedge to remain at 23820 Lynwood in the Echo Valley Subdivision. The property is zoned R-1 and located south of Ten Mile Road and west of Beck Road.

CITY OF NOVI CODE OF ORDINANCES Section 2513 Corner Clearance states "No fence, wall, plant material, sign or other obstruction to vision above a height of two (2) feet from the established street grades shall be permitted within the clear view zone…"

Applicant is requesting a variance to the requirement of a two foot maximum height for plant material

IN CASE NO. 07-058 TABLE THE CASE TO SEND THE PETITIONER FOR AN ADMINSITRATIVE REVIEW BY THE CITY, ITS ENGINEERS AS WELL AS ANY APPROPRIATE REVIEWS DEEMED NECESSARY BY THE CITY AND THE CITY ATTORNEY. THE PETITIONER SHOULD RETURN TO THE BOARD FOR THE DECEMBER 4, 2007 ZBA MEETING TO VERIFY THE STATUS OF THE ADMINISTRATIVE REVIEW RESOLUTION OR THE BOARD WILL MAKE A DETERMINATION AT THAT TIME.

Applicant is requesting one ground sign variances for the new Providence Park Campus located at 47601 Grand River Avenue. Applicant requests one square foot illuminated ground sign to be located at the Beck Road Grand River intersection indicating the main entrance to the campus. Property is zoned OSC and located on the west side of Beck Road and south of Grand River Avenue.

5. Case No. 07-068 filed by Patty Loose of Sign Fabricators for 43350 Grand River Avenue Potbelly Restaurant

Applicant is requesting two wall sign variances for the new Potbelly restaurant to be located at 43350 Grand River in the Novi Town Center. Applicant requests two 82.5 square foot illuminated wall signs to be located on the north and south elevations of the building indicating the Potbelly logo. Property is zoned TC and located north of Grand River east of Novi Road.

CITY OF NOVI CODE OF ORDINANCES Section 28-5 (2) b. 1. (a) (i) a. Area height and placement states: "A business having a first floor pedestrian entrance shall be allowed one and one-fourth (1 1/4/) square feet of signage per linear foot of contiguous public or private street frontage up to a maximum of sixty-five (65) square feet."

CITY OF NOVI CODE OF ORDINANCES Section 28-5 (3) Number of signs permitted states "No building or parcel of land shall be allowed more than one (1) sign."

CITY OF NOVI CODE OF ORDINANCES Section 28-5 (3) f. 6. Case No. 07-059 filed by Scott Smith of Clark Hill for the Adell Brothers Trust

Applicant is requesting the consideration of a delayed administrative appeal of a determination by the Deputy Director of Community Development stating the use of the former Novi Expo Center as a trade center/market does not fall within the uses allowed in an EXPO district. Applicant is further requesting a use variance from the strict application of the provisions of Article 10 EXO Exposition Overlay District of the Novi Zoning Ordinance. Property is zoned EXPO and located west of Novi Road and south of I-96.

CITY OF NOVI ZONING BOARD OF APPEALS Rules of Procedure, Article IX Amendments and Appeals to the Board, Section 9.1, Appeals to the Board, states: "Any applicant shall have the right to an appeal to the board no later than thirty (30) days from the administrative action, which is the subject of the appeal. If the right to appeal expires, an Applicant may seek leave to bring a delayed appeal based upon clear and convincing demonstration of good cause for the delayed appeal. The Board shall vote upon whether or not to consider the delayed appeal prior to consideration of the merits of the petition.

CITY OF NOVI CODE OF ORDINANCES Section 3104 1. a., Administrative Review, states: "The Zoning Board of Appeals shall…hear and decide appeals where it is alleged by the appellant that there is an error in any order, requirement, permit, decision or refusal made by the Building official or any other administrative official in carrying out or enforcing provisions of this Ordinance."

CITY OF NOVI CODE OF ORDINANCES Section 3104 1. b. , Jurisdiction, states: "The Zoning Board of Appeals shall have the power to authorize, upon appeal a variance from the strict application of the provisions of this Ordinance where by …the strict application of the regulations enacted would result in peculiar or exceptional difficulties to or exceptional undue hardship upon the owner of such property provided such relief may be granted without substantially impairing the intent and purpose of the Ordinance."

Applicant is requesting consideration of a delayed appeal, an administrative appeal, or, alternatively, a use variance.

7. Case No. 07-069 filed by Jeff Prymas of Gardner signs Inc. for Huntington Bank located at 43200 Ten Mile Road

Applicant is requesting three sign variances for the new Huntington Bank to be located at 43200 Ten Mile Road. Applicant is requesting one 36 square foot wall sign variance for the placement of an additional illuminated wall sign for the south elevation of the building. Applicant has already been approved for an illuminated wall sign on the west elevation of the building. Applicant is also requesting one 2.5 square foot area variance and one 2-foot height variance for an 8’ x 5’ ground sign with a three-foot high base. Property is zoned B-3 and located north of Ten Mile Road and east of Novi Road.

IN CASE NO. 07-069 TO DENY THE TWO VARIANCE REQUESTS FOR A GROUND SIGN ON NOVI ROAD DUE TO THE FACT THAT THERE WILL BE ADDITIONAL TENANTS IN THE BUSINESS CENTER IN THE FUTURE AND WE NEED TO DEAL WITH THE SIGN AS AN ENTIRE CENTER SIGN AND NOT AS ONE TENANT.

8. Case No. 07-070 filed by Patti Franz of Metro Detroit Signs for Staybridge Suites located at 48101 Grand River Avenue

Applicant is requesting one sign variance for the new Staybridge Suites Extended Stay Hotel to be located at 48101 Grand River Avenue; part of the Providence Park Campus. Applicant is requesting one 52.85 square foot wall sign variance for the placement of an illuminated wall sign for the east elevation of the building. Applicant has already been approved for a ground sign for this business. Property is zoned OSC and located west of Beck Road and south of Grand River Road.

CITY OF NOVI CODE OF ORDINANCES Section 28-5 (3) Number of on-premises advertising signs permitted states: "No building or parcel of land shall be allowed more than one (1) sign permitted."

Applicant is requesting an additional sign for the Staybridge Suites Extended Stay Hotel.

IN CASE NO. 07-070 TO APPROVE THE VARIANCE AS REQUESTED GIVEN THAT THE PETITIONER HAS ESTABLISHED A PRACTICAL DIFFICULTY. THE REQUEST IS BASED ON CIRCUMSTANCES AND FEATURES EXCEPTIONAL AND UNIQUE TO THEIR PROPERTY GIVEN THE SIZE OF THE CAMPUS AND THE CONSTRUCTION OF SAID BUILDING. THE GRANTING OF THE VARIANCE WILL NOT INTERFERE WITH THE COMPATIBILITY OF THIS AREA TO SURROUNDING AREAS AND IT DOES SUBSTANTIAL JUSTICE TO THIS PETITIONER AND OTHERS IN THE SURROUNDING AREA.

9. Case No. 07-071 filed by Heileman Signs for Suburban Chrysler, Jeep, Dodge located at 24315 Haggerty Road

Applicant is requesting one wall sign variance from previously approved variances in ZBA95-041 and ZBA02-079 for Suburban Chrysler, Jeep Dodge located at 24315 Haggerty Road. Applicant is requesting the addition of a 48.28 square foot wall sign reading "Dodge" on the front elevation of the building. Current signage includes copy that reads Chrysler, Jeep and Suburban. Property is zoned B-3 and located north of Ten Mile Road and west of Haggerty Road.

IN CASE NO. 07-071 TO GRANT THE VARIANCE FOR THE ADDITIONAL SIGN NOT TO EXCEED 38 SQUARE FEET IN OVERALL SQUARE FOOTAGE AS THE CITY ORDINANCE MEASURES SIGNAGE FOR THE REASON THAT THE ADDED PRODUCT LINE WARRANTS THE ADDITIONAL SIGNAGE. THE CONDITION OF REDUCING THE SIZE OF THE SIGN IS TO MAKE THE ADDITIONAL SIGNAGE PROPORTIONAL TO THE EXISTING SIGNANGE.

10. Case No. 07-072 filed by Bill Lutz of Sign Graphix, Inc. for ITC Holdings Corporation

Applicant is requesting two illuminated wall sign variances for the ITC Transmission Headquarters located at 27175 Energy Way. Applicant is requesting one forty-eight (48) square foot variance for the placement of a one hundred and thirteen (113) square foot wall sign for the north elevation of the parking deck as well as one thirteen (13) square foot variance for the placement of a seventy-eight (78) square foot wall sign for the west elevation of the office building. Property is zoned OST and located south of Twelve Mile Road and west of Haggerty Road.

Applicant is requesting two wall sign variances for the ITC Transmission Headquarters.

IN CASE NO. 07-072 TO GRANT THE PETITIONER’S REQUEST AS SUBMITTED GIVEN THE EXCEPTIONAL AND UNIQUE CIRCUMSTANCES IN THE SIZE OF THE LOT AND THE SIZE OF THE BUILDING AS WELL AS SECURITY REGULATIONS SURROUNDING THIS PROJECT AND THE GRANTING OF THESE VARIANCES WILL RESULT IN SUBSTANTIAL JUSTICE FOR THIS PETITIONER AS WELL AS SURROUNDING PROPERTIES.

12. Case No. 07-074 filed by Rino Soave of Soave Corporation for Pinebrook Plaza located south of Grand River Avenue and east of Joseph Road

Applicant is requesting a variance to the required number of off street parking spaces for a combined parking lot for two new buildings to be located in the Pinebrook Professional Plaza. Applicant is requesting thirty-five parking spaces for a professional office building and a medical dental building parking lot for the plaza. Property is zoned NCC and located south of Grand River Avenue and east of Joseph Drive.

CITY OF NOVI CODE OF ORDINANCES Section 2505.14.d (2) Number of Minimum Parking Spaces per Unit of Measure states: "One parking space for each two hundred and twenty- two square feet of GLA for buildings up to 100,000 square feet."

IN CASE NO. 07-074 GRANT THE VARIANCE AS REQUESTED DUE TO THE LIMITED USE OF THE PARKING REQUIRED BY PATIENTS REQUIRING THE TYPE OF MEDICAL USE IN THIS BUILDING. APPLICANT HAS SATISFIED THE CITY’S CONCERNS REGARDING THE VARIANCE REQUEST. THIS VARIANCE APPLIES TO THE SITE ONLY WHILE THE OAKLAND ORAL SURGEONS AND ASSOCIATES TENANT OCCUPIES THE SITE, AND WOULD NOT APPLY TO ANOTHER MEDICAL OFFICE USE AND THE REMAINDER OF THE TENANT SPACES ON THE SITE BE USED FOR GENERAL OFFICE USES ONLY.

13. Case No. 07-075 filed by Jim Clear of Novi Town Center Investors LLC for the Novi Town Center located at 43390 Grand River Avenue

Applicant is requesting one ground sign and four logo sign variances for a business center sign to be located at 43390 Grand River Avenue for the Novi Town Center. Applicant is requesting a one-foot eight and three quarter inch by fifteen-foot four-inch sign as part of a decorative brick wall anchored by brick columns displaying two twenty-four inch by twenty-four inch logo signs. Applicant is further requesting two additional sixteen-inch by sixteen inch logo signs to be displayed on the reverse side of the brick columns. The decorative brick wall and columns will require site plan review and approval. There is currently one other business center sign located on this parcel and 3 additional business center signs identifying the Novi Town Center. Property is zoned TC and located north of Grand River Avenue and east of Novi Road.

Applicant is requesting a business center sign with logos for the Novi Town Center.

IN CASE NO. 07-075 GRANT THE PETITIONER’S REQUEST GIVEN THE FACT THAT THE PETITIONER HAS ESTABLISHED HARDSHIPS BASED ON THE FOLLOWING GROUNDS: THE LARGE SITE BEING OVER 53 ACRES, THE IRREGULAR PROPERTY LINES, THE EXCESSIVE DISTANCE BETWEEN THE CURRENT IDENTIFICATION SIGNS, TO ASSIST IN THE TRAFFIC AND THE COORDINATION OF THE OTHER SIGNS AS WELL AS THE CONFUSION WITH MAIN STREET AND THE MALL TO THE NORTH OF THE FREEWAY AS WELL AS THE MULTIPLE BUSNISSES IN THE TC DISTRICT.

OTHER MATTERS

Committee Update – Rules of Procedure

Member Fischer reported the committee has multiple updates for the Board to consider at the December meeting.

2008 ZBA Calendar Dates

The Board approved the 2008 ZBA calendar dates with one change. The March 2008 meeting will be held on Monday March 10, 2008 rather than Tuesday to accommodate the Board of Review being held on Tuesday March 12, 2008. The Board unanimously approved the revised schedule and newly proposed meeting time of 7:00 p.m. for the calendar year of 2008.
