Rules of Conduct:

  1. Please turn off pagers and cell phones during the meeting.
  2. Each person desiring to address the Board shall state his / her name and address.
  3. Individual persons shall be allowed five (5) minutes to address the Board, an extension of time may be granted at the discretion of the Chairperson.
  4. There shall be no questioning by the audience of the persons addressing the Board; however, the Board members may question that person with recognition of the Chairperson.
  5. No person shall be allowed to address the Board more than once unless the Chairperson grants permission.
  6. One spokesperson for a group attending shall be allowed ten (10) minutes to address the Board.

Approval of Minutes – July 11, 2006 – Approved

1. Case No. 06-53 filed by Novi Town Center Investors at 26045 Town Center Drive

The Novi Town Center Investors is requesting a variance for the reduction in loading space of four hundred – ninety (490) square feet for the construction of proposed Building 3 in the Novi Town Center Outlot. Property is located north of Grand River Avenue, west of Town Center Drive and zoned Town Center District.

NOVI CODE OF ORDINANCES; Section 2507, paragraph (2) states: "Within a TC District, loading, unloading space shall be provided in the rear yard at a ratio of ten (10) square feet for each front foot of building". Building’s south face has eighty-six (86) feet.

REQUIRED LOADING/UNLOADING SPACE 860 SQUARE FEET
PROPOSED LOADING/UNLOADING SPACE 370 SQUARE FEET
VARIANCE REQUESTED 490 SQUARE FEET

Applicant is requesting for a reduction in required loading area.

IN CASE NO. 06-053 TO GRANT THE VARIANCE FOR A 490 SQUARE FOOT REDUCTION IN LOADING SPACE DUE TO THE UNIQUE SHAPE OF THE LOT AND THAT THE PROPOSED USE OF THE BUILDING WILL NOT EXCEED THE USE OF ANY DELIVERY VEHICLE OVER THIRTY (30) FEET.

 

2. Case No. 06-057 filed by Nancy Long of A-1 Expeditors for Chase Bank at 39820 Eight Mile Road

A-1 Expeditors for Chase Bank at 39820 Eight Mile Road is requesting one sign variance for the continued placement of a wall sign erected without obtaining a sign permit. This property is zoned OSC and located on the northwest corner of Eight Mile and Haggerty Roads.

CITY OF NOVI, CODE OF ORDINANCES Section 28-6(3) states: "No building or parcel of land shall be allowed more than one (1) sign permitted under this section…"

Applicant is requesting permission to continue use of a wall sign erected without obtaining a Sign Permit.

IN CASE NO. 06-057 TO GRANT THE CONTINUED USE OF A WALL SIGN THAT WAS ERECTED DURING THE CHANGEOVER FROM BANK ONE TO CHASE BANK NOTING THAT THE SIGN WAS ERECTED WITHOUT OBTAINING A SIGN PERMIT. THE SIGN IS JUSTIFIED DUE TO THE DIFFICULTIES IN BUILDING RECOGNITION EVEN WITH THE SINGLE GROUND SIGN BEING PRESENT.

 

3. Case No. 06-58 filed by Andrew & Susan Soborowski of 1407 East Lake Drive

Andrew & Susan Soborowski are requesting three (3) setback variances for the construction of an upper level deck within the front and side yards of the existing home located at 1407 East lake Drive. Applicant is requesting a 9.17-foot (north) side yard setback variance, a 9.33-foot (south) side yard setback variance and an 8.6 front yard setback variance. Property is zoned R-4 and located north of Thirteen Mile Road and east of Old Novi Road. NOTE: Previous deck approval ZBA90-1859.

NOVI CODE OF ORDINANCES Section 2908, "Projections into Yards" states that vertical projections up to ten (10) feet in length and not occupying more than thirty (30) percent of the length of the wall on which they are located may project into the required side yard not more than two (2) inches for each one (1) foot of width of such side yard.

NOVI CODE OF ORDINANCES Section 2907, "Porches: Decks" states that an open, unenclosed and uncovered porch or paved terrace may project into a required front yard setback for a distance not to exceed four (4) feet.

PROPOSED MINIMUM FRONT YARD SETBACK 17.4 FEET
VARIANCE REQUESTED 8.6 FEET

Applicant is requesting three (3) setback variances for the construction of an upper level deck.

IN CASE NO. 06-058 TO GRANT THE SIDE YARD SETBACK (NORTH) VARIANCE OF 9.17 FEET, THE SIDE YARD SETBACK (SOUTH) VARIANCE OF 9.33 FEET AND THE FRONT YARD SETBACK VARIANCE OF 8.6 FEET DUE TO THE UNIQUE SHAPE OF THE LOT.

 

4. Case No. 06-059 filed by Jurek Baczewski of 2035 N. Gulley Road for 1945 West Lake Drive

George Baczewski is requesting four (4) setback variances for the construction of a new home at 1945 West Lake Drive. Applicant is requesting a ten (10) foot north side yard setback variance, a five (5) foot south side yard setback variance with a combined total side yard setback variance of fifteen (15) feet and a front yard setback variance of five (5) feet. Existing building is to be demolished and removed.

Property is zoned R-4 and located north of South Lake Drive and east of West Park Drive.

NOVI CODE OF ORDINANCES ARTICLE 24 Section 2400, "Schedule of Regulations" require a minimum side yard setback of ten (10) feet with a combined side yard setback total of twenty-five (25) feet and a minimum front yard setback of thirty (30) feet.

OTHER MATTERS

1. ZBA06-061 - Angela Hospice Fundraising/Benefit Sign discussion.

Mr. Saven apprised the board of the request from Mr. Bart Wingblad to erect the Angela Hospice Benefit sign at the NE corner of Grand River and Beck Roads.

2. ZBA05-107 – Villagewood Place Sales/Marketing Sign correspondence.

Mr. Saven asked that the board members be aware of the correspondence received by the building department regarding the Villagewood Place apartments.
