Rules of Conduct:

  1. Each person desiring to address the Board shall state his / her name and address.
  2. Individual persons shall be allowed five (5) minutes to address the Board, an extension of time may be granted at the discretion of the Chairperson.
  3. There shall be no questioning by the audience of the persons addressing the Board; However, the Board members may question that person with recognition of the Chairperson.
  4. No person shall be allowed to address the Board more than once unless permission is granted by the Chairperson.
  5. One spokesperson for a group attending shall be allowed ten (10) minutes to address the Board.

Public Remarks

Sarah Gray, congratulated Member Sanghvi on his recent appointment to City Council.

1) Case No. 02-107 filed by Steve McCann representing Sun Glo at 22960 Venture Drive

Steve McCann is requesting a 5.09 foot side yard parking setback variance on the south side for the construction of Venture Drive Spec Building "B" parking lot (user is Sun Glo). The applicant is proposing additional parking between the south building elevation and the south property line. The Zoning District is I-1.

CITY OF NOVI, CODE OF ORDINANCE, Article 24, Section 2400, "Schedule of Regulations" requires a minimum side yard parking setback of ten (10) feet in an I-1 Zoning District.

Required side yard parking setback (south side): 10 feet

Proposed: 4.91 feet

Variance: 5.09 feet

MOTION: THAT IN CASE NUMBER 02-107 TO GRANT THE PETITIONER’S REQUEST FOR A SIDE YARD PARKING SETBACK VARIANCE OF 5.09 FEET DUE TO BUILDING PLACEMENT AND PARKING REQUIREMENTS

2) Case No. 02-108 filed by Rock Marasco representing Progressive Tool & Industries at 44000 Grand River

Rock Marasco of MLS Signs representing Progressive Tool & Industries is requesting a sign variance to allow an existing sign that was erected without a permit to remain. The Zoning Board of Appeals granted a variance on October 27, 1987 for the signage and kept it under their continuing jurisdiction (Case #1504). The approved sign was limited to six feet by five feet and eleven feet in height.

The applicant is requesting permission to allow the existing sign to remain as forty two (42) square feet and eleven feet, six inches in height.

MOTION: THAT IN CASE NUMBER 02-108 TO GRANT THE PETITIONER’S REQUEST FOR THE SIZE AND LOCATION OF THE SIGN SUBJECT TO THE PETITIONER COMING BACK TO THE BOARD IF THE SIGN IS REQUIRED TO BE MOVED OR REMOVED BECAUSE OF THE ROAD PROJECT

3) Case No. 02-109 filed by Tom Welch of Hershey’s Shoes Too at 47750 Grand River (Westmarket Square)

Tom Welch of Hershey’s Shoes Too is requesting permission to allow two (2) illuminated signs in the window at 47750 Grand River in the Westmarket Square development. The verbiage of the signs are "Stride Rite" and "SAS – America’s Favorite Comfort Shoes."

CITY OF NOVI, CODE OF ORDINANCE, Section 28-8(14)(b) states:

"Business signs displayed through building glass area where such sign…is not illuminated."

The applicant is requesting permission to allow two (2) illuminated signs to remain in the window.

MOTION: THAT IN CASE NUMBER 02-109 TO DENY THE PETITIONER’S REQUEST FOR TWO (2) ILLUMINATED SIGNS BECAUSE THEY ARE ADVERTISING SIGNS

4) Case No. 02-110 filed by Kevin Short representing Intier Automotive at 39600 Lewis Drive (Haggerty Corridor Corporate Park)

Kevin Short of Huron Sign Co. representing Intier Automotive is requesting one (1) sign variance to erect a ground sign at 39600 Lewis Drive in the Haggerty Corridor Corporate Park.

 

 

CITY OF NOVI, CODE OF ORDINANCE, Section 28-6(3) states:

"…no building or parcel of land shall be allowed more than one (1) sign permitted under this section…"

The applicant is requesting permission to erect a thirty (30) square foot ground sign.

CASE TABLED TO FEBRUARY 4, 2003 MEETING

5) Case No. 02-112 filed by Jason Cooper of Amson Dembs Development, Inc. for Parcel #31 at Haggerty Corridor Corporate Park

Jason Cooper of Amson Dembs Development, Inc. is requesting an extension to allow his construction trailer to remain for two more years at 5022-12-200-027, parcel #31 in the Haggerty Corridor Corporate Park. The applicant had received a Temporary Use Permit on July 6, 2000.

MOTION: THAT IN CASE NUMBER 02-112 TO GRANT THE PETITIONER’S REQUEST TO ALLOW THE CONSTRUCTION TRAILER TO REMAIN FOR A PERIOD OF ONE (1) YEAR FOR BUILDING REQUIREMENTS AND TO MAINTAIN CONTINUING JURISDICTION

6) Case No. 02-113 filed by Marvin Daitch representing Scenic Pines Estates

Marvin Daitch is requesting two (2) variances for the project known as Scenic Pines Estates located in Section 3, south of Pembine between Buffington and Henning. A variance is requested to allow an accessory structure to remain at its existing location and a five (5) foot variance to allow street trees to be placed within the ten (10) foot minimum distance to the driveway.

CITY OF NOVI, CODE OF ORDINANCE, Section 2503, Paragraph 1 (B) "Accessory Buildings" states: "Accessory buildings shall not be erected in any required front yard or in any required exterior side yard."

The applicant is requesting to allow the accessory structure (garage) to remain in its existing location. The existing accessory building is located within the required seventy five (75) foot setback from Pembine Road.

CITY OF NOVI, CODE OF ORDINANCE, Subdivision Ordinance, Section 4.03B2a requires that all street trees shall not be planted closer than ten (10) feet from any driveway.

The applicant is requesting to plant street trees at a distance of five (5) feet from the driveways requiring a five (5) foot variance.

MOTION: THAT IN CASE NUMBER 02-113 (A) TO DENY THE PETITIONER’S REQUEST FOR THE GARAGE DUE TO THE FACT THAT THERE IS SUFFICIENT PROPERTY TO LOCATE A STORAGE FACILITY IF NEEDED AND THE FACT THAT THIS IS NEW CONSTRUCTION

THAT IN CASE NUMBER 02-113 (B) TO GRANT THE PETITIONER’S REQUEST FOR THE TREES SUBJECT TO THE CONDITIONS THAT THE LANDSCAPE ARCHITECT HAS PUT ON HER RECOMMENDATION

OTHER MATTERS

1) Election of Vice - Chair

Member Gray was elected to the position of Vice-Chair of the Board.
