REGULAR MEETING – ZONING BOARD OF APPEALS – CITY OF NOVI

Roll call Members Bauer, Brennan, Fannon, Gray, Gronachan, Sanghvi and Reinke

Rules of Conduct:

  1. Each person desiring to address the Board shall state his / her name and address.
  2. Individual persons shall be allowed five (5) minutes to address the Board, an extension of time may be granted at the discretion of the Chairperson.
  3. There shall be no questioning by the audience of the persons addressing the Board; However, the Board members may question that person with recognition of the Chairperson.
  4. No person shall be allowed to address the Board more than once unless permission is granted by the Chairperson.
  5. One spokesperson for a group attending shall be allowed ten (10) minutes to address the Board.

Public Remarks – Applicant for Buffalo Wild Wings will be tabling their case to next month since awnings were added to the plan and proper re-notification will be necessary.

1) Case No. 01-103 filed by Gina Blazo of All Star Gymnastics at 22515 Heslip Drive

Gina Blazo of All Star Gymnastics is requesting a sign variance to allow a directional sign to be erected in the city right-of-way at the corner of the Novex One Industrial Park, which is located at Nine Mile Road and Heslip.

CITY OF NOVI, CODE OF ORDINANCE, Section 28-11(a) states:

"A sign not expressly permitted is prohibited."

Applicant is requesting permission to erect a six (6) square foot ground sign.

MOTION: THAT IN CASE NO. 01-103 TO TABLE THIS ISSUE AT THIS POINT IN TIME AND REQUEST THE CITY TO PUT UP A BETTER, MORE VISIBLE, REFLECTIVE SIGN ON THIS PARTICULAR STREET TO TRY FOR A PERIOD OF SIX (6) MONTHS AND THEN RE-EVALUATE THE SITUATION

 

2) Case No. 02-003 filed by Taylor Scott Architects representing The Great Indoors (Fountain Walk)

Christopher Goble of Taylor Scott Architects, representing the Great Indoors is requesting a sign variance to enlarge the existing easterly sign. The Zoning Board of Appeals had previously granted a variance of ninety three (93) square feet on July 17, 2001 for a one hundred thirty three (133) square foot wall sign on the east side.

CITY OF NOVI, CODE OF ORDINANCE, Section 28-6(2)b.1.(a)ii.a. states:

"A wall sign displayed on a building occupied by two (2) or more businesses shall not exceed twenty four (24) square feet, or one (1) square foot of signage for every two (2) lineal feet of business frontage to a maximum of sixty five (65) square feet."

Requested: 407 square feet

Permitted: 40 square feet

Variance: 367 square feet

MOTION: THAT IN CASE NO. 02-003 TO DENY THE PETITIONER’S REQUEST DUE TO LACK OF PRACTICAL DIFFICULTY

3) Case No. 02-006 filed by Harold Chapman representing Buffalo Wild Wings (Fountain Walk)

Harold Chapman representing Buffalo Wild Wings located in the Fountain Walk development is requesting two (2) sign variances to erect two illuminated wall signs.

Sign A:

CITY OF NOVI, CODE OF ORDINANCES, Section 28-6(2)b.1.(a)i states:

"A wall sign displayed on a building occupied by two (2) or more businesses shall not exceed twenty four (24) square feet, or one (1) square foot of signage for every two (2) lineal feet of business frontage to a maximum of forty (40) square feet."

Requested: 96 square feet

Permitted (based on 88’ of business frontage): 40 square feet

Variance: 56 square feet

Sign B:

CITY OF NOVI, CODE OF ORDINANCES, Section 28-6(3)d states:

"Each separately owned and operated business occupying a building on a single parcel of land, which has a separate exterior entrance, is entitled to one (1) identification wall sign."

Applicant is requesting permission to erect a fifty four (54) square foot wall sign.

4) Case No. 02-007 filed by John Anderson of 207 Charlotte

John Anderson is requesting a twelve (12) foot side yard setback, a five (5) foot side yard setback and a seventeen (17) foot total aggregate variance for the continued construction of the residence located at 207 Charlotte. Applicant has previously been before the Board for ZBA Case No. 01-009 regarding multiple requests for the same parcel of land. Applicant was advised to consider previous neighborhood concerns.

CITY OF NOVI, CODE OF ORDINANCE, Article 24, Section 2400, "Schedule of Regulations" requires a minimum fifteen (15) foot side yard setback with an aggregate total of twenty five (25) feet for the two side yards in an R-4 Zoning District.

Required side yard setback (east side): 15 feet

Proposed: 3 feet

Variance: 12 feet

Required side yard setback (west side): 10 feet

Proposed: 5 feet

Variance: 5 feet

Required total aggregate on both sides: 25 feet

Proposed (on both sides): 8 feet

Variance: 17 feet

MOTION: THAT IN CASE NO. 02-007 TO APPROVE THE PETITIONER’S AMENDED REQUEST THAT IS BEFORE THE BOARD TONIGHT AS SUBMITTED DUE TO PRACTICAL DIFFICULTY AND A SMALL LOT WITH THE ADDITIONAL NOTE THAT THERE WILL BE NO ACCESSORY BUILDINGS ON THE PROPERTY

5) Case No. 02-008 filed by Jane Dietrich representing Waltonwood

Jane Dietrich of Singh Development representing Waltonwood at Twelve Oaks is requesting an extension for two signs. Sign A is located in front of the Waltonwood development on Huron Circle Drive. Sign B is located on Twelve Mile Road.

CITY OF NOVI, CODE OF ORDINANCE, Section 28-7(1) states that the maximum permit duration is:

… "valid until issuance of last certificate of occupancy or for a period of twelve (12) months, whichever occurs first."

Sign A was granted its first extension on February 1, 2000 and its second extension on February 6, 2001 to expire on February 1, 2002.

Sign B was approved on January 9, 2001 for a period of twelve (12) months.

MOTION: THAT IN CASE NO. 02-008 TO APPROVE THE EXTENSION FOR TWELVE (12) MONTHS FOR BOTH SIGNS DUE TO THE CURRENT ECONOMIC TIMES

 

6) Case No. 02-009 filed by North American Signs representing Jared Jewelry

Charley Schalliol of North American Signs representing Jared Jewelry is requesting a sign variance to erect a second wall sign located at 27795 Novi Road.

CITY OF NOVI, CODE OF ORDINANCE, Section 28-6(3) states:

"…no building or parcel of land shall be allowed more than one (1) sign permitted under this section…"

Applicant is requesting permission to erect a sixty (60) square foot illuminated wall sign on the south side of the building.

MOTION: THAT IN CASE NO. 02-009 TO APPROVE THE PETITIONER’S REQUEST TO REMOVE THE SIGN FROM THE WEST SIDE AND PUT IT ON THE SOUTH SIDE OF THE BUILDING

7) Case No. 02-010 filed by Terry Burns representing Mattress & Futon Shoppe

Terry Burns representing Mattress & Futon Shoppe is requesting a sign variance to erect a second wall sign located at 26160 Ingersol (Town Center).

CITY OF NOVI, CODE OF ORDINANCE, Section 28-6(3) states:

"…no building or parcel of land shall be allowed more than one (1) sign permitted under this section…"

Applicant is requesting permission to erect a thirty (30) square foot illuminated wall sign.

MOTION: THAT IN CASE NO. 02-010 TO APPROVE THE SIGN VARIANCE TO LOCATE THE THIRTY (30) SQUARE FOOT SIGN ON THE SOUTH SIDE AS LONG AS ALL OTHER SIGNS IN THE WINDOW ON THE SOUTH SIDE ARE REMOVED

8) Case No. 02-011 filed by Joe Nutting of 621 South Lake Drive

Joe Nutting is requesting five (5) variances for the construction of his new home located at 621 South Lake Drive. The applicant is requesting a ten foot one inch (10’1") rear yard setback, a ten (10) foot side yard setback on one side, a five (5) foot side yard setback on the other side, an aggregate total side yard variance of fifteen (15) feet and a 9.5% variance for lot coverage. The applicant’s lot contains buildings, which have existing non-conforming setbacks. The property is zoned R-4.

CITY OF NOVI, CODE OF ORDINANCE, Article 24, Section 2400, "Schedule of Regulations" requires the following: a minimum rear yard setback of thirty five feet, a minimum side yard setback of ten feet on one side, an aggregate total of twenty five feet for both side yards, five feet on the other side yard and a twenty five percent maximum lot coverage.

Required rear yard setback: 35 feet

Proposed: 24 feet, 11 inches

Variance: 10 feet, 1 inch

Required side yard setback: 10 feet

Proposed: 5 feet

Variance: 5 feet

Required side yard setback (other): 15 feet

Proposed: 5 feet

Variance: 10 feet

Required total aggregate (sides): 25 feet

Proposed: 10 feet

Variance: 15 feet

Required maximum lot coverage: 25%

Proposed: 34.5%

Variance: 9.5%

9) Case No. 02-012 filed by Robert Janik of 2300 Old Novi Road

Robert Janik is requesting three (3) variances for the construction of an addition and garage for the property located at 2300 Old Novi Road. The applicant is seeking two (2) front yard variances of 10.6 feet off of Old Novi Road and 20 feet off of Austin and a rear yard variance of ten (10) feet. The property is an unusually shaped corner lot located in a R-4 Zoning District.

CITY OF NOVI, CODE OF ORDINANCE, Article 24, Section 2400, "Schedule of Regulations" requires a minimum front yard setback of thirty (30) feet and a rear yard setback of thirty five (35) feet in a R-4 Zoning District.

Required front yard (Old Novi Road): 30 feet

Proposed: 19.4 feet

Variance: 10.6 feet

Required front yard (Austin): 30 feet

Proposed: 10 feet

Variance: 20 feet

Required rear yard setback: 35 feet

Proposed: 25 feet

Variance: 10 feet

MOTION: THAT IN CASE NO. 02-012 TO DENY THE PETITIONER’S REQUEST DUE TO LACK OF PRACTICAL DIFFICULTY AND THE LOCATION OF THE GARAGE

10) Case No. 02-013 filed by Holly & Jason Waechter of 45475 Addington Lane

Holly & Jason Waechter are requesting one variance to construct a roof over the patio at the property located at 45475 Addington Lane. The applicants are seeking a rear yard variance of 7.94 feet.

CITY OF NOVI, CODE OF ORDINANCE, Article 24, Section 2400, "Schedule of Regulations" requires a minimum rear yard setback of thirty five (35) feet in a R-3 Zoning District.

Required rear yard: 35 feet

Proposed: 27.06 feet

Variance: 7.94 feet

MOTION: THAT IN CASE NO. 02-013 TO APPROVE THE APPLICANT’S REQUEST TO COVER THE PATIO BECAUSE OF SPECIAL CIRCUMSTANCES OF THE WETLANDS AND WOODLANDS BEHIND THE HOUSE AND THE LOCATION OF THE HOUSE WITH THE SUN PRODUCING PROBLEMS

11) Election of officers

Motion: To nominate Member Brennan as the new Chair.

Motion: To nominate Member Fannon as the new Vice-Chair.

Motion: To nominate Member Sanghvi as the new Secretary.

OTHER MATTERS

1) Chris Stone – Park Place

Chris Stone, a new resident of Novi, will be moving to Park Place. However, he had a problem with the surveyor and builder and the house was put fifteen (15) feet closer to the road then it was supposed to be. He wanted to introduce himself to the Board since he will be coming next month.

2) Congratulations to Member Reinke

The Board congratulated Member Reinke on a job well done as Chairman and also for becoming a grandfather of twins.
