Rules of Conduct:

  1. Each person desiring to address the Board shall state his / her name and address.
  2. Individual persons shall be allowed five (5) minutes to address the Board, an extension of time may be granted at the discretion of the Chairperson.
  3. There shall be no questioning by the audience of the persons addressing the Board; However, the Board members may question that person with recognition of the Chairperson.
  4. No person shall be allowed to address the Board more than once unless permission is granted by the Chairperson.
  5. One spokesperson for a group attending shall be allowed ten (10) minutes to address the Board.

Public Remarks

1. Timothy Stoepker, representing Jaguar of Novi was requesting the Board to allow him to be on the November agenda without having walls constructed for the purpose of the mock-up signs.

2. Margaret Laurie, 1127 South Lake was asking for the Board for help regarding her next door neighbor, Andy Kowal.

3. Roland McMichael, 1127 South Lake was also asking the Board for help regarding his next door neighbor, Andy Kowal.

4. Sarah Gray, 133 Maudlin invited the Board to the Haunted Woods, which would take place this weekend and next, from 7:00 pm until 10:00 pm.

1) Case No. 01-072 filed by Fifty Five Marketing Group representing Brownstones at the Vistas

Colleen Sloan representing Brownstones at the Vistas is requesting an extension for an off-premise sign located at 13 Mile and Novi Road for a temporary directional sign. Please see Case No. 00-041.

MOTION: THAT IN CASE NO. 01-072 TO GRANT THE PETITIONER’S REQUEST FOR A ONE (1) YEAR EXTENSION ON A SIGN PERMIT FOR THE PURPOSE OF SELLING OUT

2) Case No. 01-079 filed by Four Seasons Sunroom representing homeowners of 47225 Autumn Park Court

Rick Hadad representing George and Margaret Surdu is requesting a variance of 4.67 feet to allow placement of a sunroom within ten (10) feet of a swimming pool at 47225 Autumn Park Court.

CITY OF NOVI, CODE OF ORDINANCES, Section 2503, Paragraph 1 (D) states that no detached accessory structure shall be located closer than ten (10) feet to any main building.

Required setback from pool: 10 feet

Proposed: 5.33 feet

Variance: 4.67 feet

MOTION: THAT IN CASE NO. 01-079 TO APPROVE THE VARIANCE REQUEST OF 4.67 FEET FOR THE REQUIRED SETBACK FROM THE POOL DUE TO THE LOT CONFIGURATION AND THE PLACEMENT OF THE POOL IN REGARDS TO THE EASEMENTS

3) Case No. 01-080 filed by Blair Bowman representing Vision Spa & Salon

Blair Bowman, representing Vision Spa & Salon is requesting a variance to allow a side yard loading area for the proposed development of the property located at sidwell number 5022-16-300-053. The property is zoned OS-1.

CITY OF NOVI, CODE OF ORDINANCES, Section 2507, Paragraph (1) "Off Street Loading and Unloading" states:

"Within the OS Districts, loading space shall be provided within the rear yard…"

The proposed development indicates side yard loading.

MOTION: THAT IN CASE NO. 01-080 TO GRANT THE APPLICANT’S REQUEST TO ALLOW SIDE YARD LOADING DUE TO THE PRESENCE OF WETLANDS AND LOT CONFIGURATION

4) Case No. 01-081 filed by Robert Loynes of 44159 Durson

Robert Loynes, homeowner of 44159 Durson is requesting two (2) variances to allow the construction of a detached accessory building in the rear yard of Lot 46, Novi Heights Subdivision. The building is 34’ x 25’. These requested variances are for the allowance of more than one detached accessory building on a lot and an additional 504 square feet for the accessory building. The property is zoned R-4.

CITY OF NOVI, CODE OF ORDINANCES, Section 2503, Paragraph 1 (G) "Accessory Uses" states:

"Notwithstanding the above, not more than one (1) detached accessory building shall be permitted on any lot having less than 21,780 square feet of area."

Property contains 19,800 square feet in area. One detached building is being proposed and one shed already exists on the property.

CITY OF NOVI, CODE OF ORDINANCES, Section 2503, Paragraph 1 (G) "Accessory Uses" states that the maximum sum total of all accessory buildings in an R-3, R-4 and RT District is 850 square feet.

Proposed total square feet of all Accessory Buildings: 1354 square feet

Allowable square feet of all Accessory Buildings: 850 square feet

Variance: 504 square feet

MOTION: THAT IN CASE NO. 01-081 TO ALLOW THE APPLICANT TO MAINTAIN THE 12 X 12 SHED, TO REMOVE THE SMALL SHED THAT IS ON THE EAST SIDE AND TO APPROVE THE NEW STRUCTURE THAT WILL BE 625 SQUARE FEET (25 X 25)

 

5) Case No. 01-082 filed by Sandra Marderosian of 23141 Meadowbrook

Sandra Marderosian, homeowner, is requesting an 8.92 side yard setback variance on the north side of the property to allow the construction of an addition at 23141 Meadowbrook Road.

CITY OF NOVI, CODE OF ORDINANCES, Article 24, Section 2400, "Schedule of Regulations", paragraph (r) requires a minimum of a ten (10) foot side yard setback on one side with an aggregate total of thirty (30) feet for the sum of the two side yards.

North side: Required side yard setback: 18.10 feet

Proposed: 9.18 feet

Variance: 8.92 feet

Aggregate total of both sides: Required side yard setback (total): 30 feet

Proposed: 21.08 feet

Variance: 8.92 feet

MOTION: THAT IN CASE NO. 01-082 TO GRANT THE PETITIONER’S REQUEST OF 8.92 FEET FOR THE SIDE YARD SETBACK BECAUSE OF A VERY PECULIAR LOT CONFIGURATION AND PRESENCE OF WATER AT THE REAR OF THE PROPERTY

 

6) Case No. 01-084 filed by Lee Mamola representing DTE Energy Technologies

Lee Mamola representing DTE Energy Technologies is requesting an interpretation/variance to the screening requirements for the exhaust stacks as an element of the manufacturing of electricity for the property located at 42930 W. Ten Mile Road.

CITY OF NOVI, CODE OF ORDINANCES, Section 2503, Paragraph 2 (E) 1 "Accessory Structures" states that all roof top climate control equipment, elevator towers, transformer units, and satellite dish antenna and similar items shall be screened from view so as to not be visible from any street road or adjacent property.

Applicant is seeking an interpretation/variance to the screening requirements.

7) Case No. 01-085 filed by Al Evers of 109 Penhill

Al Evers, homeowner of 109 Penhill, is seeking two variances to construct a second story on top of an existing home. He is requesting a side yard variance of one (1) foot and a variance to enlarge the structure.

CITY OF NOVI, CODE OF ORDINANCES, Article 25, Section 2502.4.A. "Nonconforming Structures" states that "no such structure may be enlarged or altered in a way which increases its nonconformity."

Applicant is adding a second story on top of the existing home.

CITY OF NOVI, CODE OF ORDINANCES, Article 24, Section 2400, "Schedule of Regulations" states that there must be at least ten (10) feet in the side yard.

Required side yard setback: 10 feet

Proposed: 9 feet

Variance: 1 foot

MOTION: THAT IN CASE NO. 01-085 TO GRANT THE APPLICANT’S REQUEST FOR A ONE (1) FOOT SIDE YARD SETBACK VARIANCE BASED ON PUTTING A SECOND STORY ON TOP OF AN EXISTING HOME THAT HAS BECOME HIS HARDSHIP DUE TO UNKNOWN DEFECTS WHEN HE PURCHASED THE HOME
